2011 Nexans 100 Year Anniversary Contest
OFFICIAL CONTEST RULES
THESE RULES GOVERN THE 2011 NEXANS 100 YEAR ANNIVERSARY CONTEST.  THEY EXEMPT NEXANS CANADA INC. AND ITS AFFILIATES FROM CERTAIN LIABILITY AND CONTAIN IMPORTANT PROVISIONS. BY ENTERING THE CONTEST, YOU ACKNOWLEDGE AND SIGNIFY THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO BE BOUND BY THESE RULES. IF YOU DO NOT AGREE WITH EACH PROVISION OF THESE RULES, YOU MAY NOT PARTICIPATE IN THE 2011 NEXANS 100 YEAR ANNIVERSARY CONTEST.
1. Contest.  The 2011 Nexans 100 Year Anniversary Contest (the “Contest”), offered by Nexans Canada Inc. (“Nexans”) commences at 12:01 a.m. EST on February 11, 2011 and concludes at 5:00 p.m. EST on December 15, 2011 (the “Contest Period”) after which time the Contest will be closed and no further entries shall be accepted.
2. Entry.  Entry in the Contest requires the individual to complete and submit the entry form available online at - www.nexans.ca/100 (the “Entry Form”) prior to the end of the Contest Period.  Only one Entry Form per person, per calendar month is permitted and persons making multiple entries in a calendar month may be disqualified. NO PURCHASE OR PAYMENT IS NECESSARY IN ORDER TO PARTICIPATE IN THE CONTEST.

 

3. Deadline for Entries.  To be eligible for the Contest, all Entry Forms must be received by Nexans by no later than the close of business, which is 5:00 p.m. EST, on the day of the Draw (defined below).  All Entry Forms become the property of Nexans and receipt will not be acknowledged, nor will the Entry Form be returned. Nexans is not obligated to engage in correspondence regarding the Contest with any person other than the Selected Entrant. Entries shall be deemed to be submitted by the authorized account holder of the e-mail address associated with the entry. The  “authorized account holder” of an e-mail address is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
4. Eligibility.  The Contest is open to all legal residents of Canada who have reached the age of majority in their Province of residence as of the time of entry into the Contest.  By entering the Contest the entrant represents and warrants to Nexans that they are a Canadian resident who has reached the age of majority in their Province of residence as of the time of entry. Nexans shall have the right to require proof of identity and/or eligibility to participate in the Contest, at any time. Failure to provide such proof may lead to disqualification.
5. Not Eligible.  Employees, directors and officers of Nexans, and its affiliates, are not eligible to enter the Contest, nor is any person with whom such employee, director or officer resides.
6. Chance of Winning.  The chance of winning a Prize as part of the Contest depends on the total number of eligible entries received by Nexans during the Contest Period.  There is no maximum number of entrants.

 

7. Prizes.  Prizes shall consist of the following items: (a) a total of  ten (10) Apple IPods, each with an approximate value of CDN$200, with one awarded each month in accordance with Section 9 (the “Monthly Prizes”), and (b) a grand prize of one (1) Apple IPad with an approximate value of CDN$1500 (the “Grand Prize”, and collectively with the Monthly Prizes, the “Prizes”).  Nexans reserves the right to substitute a Prize of equal or greater value if the Prize cannot be awarded for any reason. 
8. Non-Transferrable. 
The Prizes do not include any other fees, charges or benefits, all of which are the Prize winner’s sole responsibility. The Prizes are not transferable or convertible to cash and will be awarded to the confirmed winner only.
9. Draw. 
The Monthly Prizes will be awarded on the last business day of each month starting February 28, 2011 and ending on November 30, 2011, and the Grand Prize will be awarded on December 15, 2011, with all draws being conducted by random draw at 140 Allstate Parkway, L3R 0Z7, Markham, Ontario, Canada on each such date at 5:00 p.m. EST (individually, a “Draw”, collectively, the “Draws”) from all eligible Entry Forms received by or before the applicable Draw.  The participant having submitted the first Entry Form selected as a result of the Draw that includes a correct answer to Nexans’ corporate history question contained in the Entry Form will become a selected entrant and will win a Prize, subject to Section 11 (the “Selected Entrant”).  If the Selected Entrant does not respond in accordance with Section 13, the Selected Entrant will be disqualified and another entrant may be selected at Nexans sole discretion. Nexans is not responsible for the failure of a Selected Entrant to receive notification or of Nexans to receive a response.
10. Notice.  Within five (5) days following each Draw, Nexans will attempt ten (10) times to contact the winner of the Prize by telephone and/or email at the contact information provided in the entrants Entry Form. 

 

11. Winner Selection.  In order to win and collect a Prize, the Selected Entrant must:
(a) upon request, submit valid proof of identity, age and residence;
(b) correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question to be administered by Nexans via e-mail or telephone; and
(c) otherwise comply with these Rules.
12. Delivery.
Once all the conditions set out in Section 11 have been fulfilled, Nexans will deliver the prize to the Selected Entrant within fifteen (15) calendar days.
13. Failure to respond.  If the Selected Entrant does not respond to the Prize notification telephone call and/or email notification within fifteen (15) calendar days; or if the Selected Entrant does not comply with the requirements of Section 11 within fifteen (15) calendar days, then in Nexans sole discretion the Prize may be forfeited without any liability to the Selected Entrant, whereupon another entrant may be selected by Nexans by random draw in accordance with these Rules.  Such other entrant shall thereupon become the Selected Entrant.

 

14. Computer Glitch.  Nexans is not responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer or telephone transmissions or technical failure, jumbled, scrambled or misdirected transmissions, or other error of any kind whether human, mechanical or electronic.  In the event any portion of this Contest is compromised by virus, bugs, tampering, non-authorized human intervention or other causes beyond the control of Nexans, which, in the sole opinion of Nexans, corrupts, or impairs the administration, security, fairness or proper entry into the Contest, Nexans reserves the right, at its sole discretion, to suspend or terminate this Contest.  Persons found tampering with or abusing any aspect of this Contest, as determined by Nexans will be disqualified.
15. Liability.  Nexans is not responsible to any Contest entrant or other person for any of the following:
(a) any expenses incurred by the entrant in taking part in the Contest or any taxes incurred as a result of winning the Prize;
(b) erroneous, damaged, destroyed, lost, late, incomplete, illegible, incorrectly addressed or misdirected Entry Forms, regardless of the cause;
(c) failure for any reason whatsoever of Selected Entrant to receive prize notification telephone calls and/or email notification;
(d) typographical or other errors in the offer or administration of the Contest, including but not limited to, errors in advertising, these Rules, the selection and announcement of the prize winner or distribution of the Prizes;
(e) changes in entrant’s contact information after Entry Forms are submitted;
(f) computer, online, telephone, communication, or technical malfunctions or errors that may occur, regardless of the cause; or
(g) damage or loss, including any loss of use, loss of production, loss of profits (anticipated or otherwise), loss of markets, economic loss, special, indirect or consequential loss or damage or punitive damages, whether in contract, tort or under any other theory of law or equity, arising from, connected with, or relating to the Contest, or the submission of the Entry Forms to the Contest, or participation in the Contest or the acceptance of a Prize, regardless of the cause.

 

16. Personal Information.  By entering the Contest, the entrant permits Nexans to collect, use and disclose the personal information provided in the Entry Form for: (i) the administration of the Contest, including but not limited to contacting and announcing the winners, and acknowledges that this personal information may be disclosed to third-parties for such purposes; (ii) marketing, advertising and consumer research purposes (if you have consented); and (iii) any purpose permitted or required by law. Nexans collection, use and disclosure of the personal information provided in the Entry Forms shall be carried out in accordance with Personal Information Protection and Electronic Documents Act, and all applicable provincial personal information protection legislation.
17. Photographs.  By entering the Contest, entrants consent to the announcement and use of the entrant’s name, address, photograph, likeness, image, biographical information, voice and statements by Nexans for advertising, promotional and information purposes without any further compensation to the entrant or any other person. 
18. General Rules.  The decisions of Nexans and/or its authorized representatives shall be final and binding on all matters related to the Contest and shall be final and binding on all entrants.  Nexans reserves the right to cancel, terminate, modify or suspend the Contest at any time, subject to the jurisdiction of the Régie des alcools, des courses et des jeux du Quebec.
19. Intellectual Property.  All intellectual property, including but limited to, trade-marks, trade names, logos, designs, promotional materials web pages, source code, drawings, illustrations, slogans and representations are owned by Nexans and/or their affiliates.  Unauthorized copying or using of any of Nexans or its affiliates intellectual property is strictly prohibited.

 

20. Applicable Law.  The Contest is subject to the laws of Canada and all other applicable laws and regulations, and is void where prohibited by law. If any provision of these Rules is found by any court of competent jurisdiction to be unenforceable, all other provisions will remain in full force and effect.
21. Non-Quebec Residents. 
For residents of all other Canadian Provinces and Territories outside Quebec, any litigation must be commenced in the City of Toronto, Ontario.
22. Quebec Residents. 
For residents of Quebec, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
23. Language.
In the event of discrepancy between the French and English version of these Contest Rules, the English version shall prevail.
